What this bill does

Plain-language analysis by the nonpartisan Legislative Reference Bureau

Current law prohibits a person from impersonating a peace officer. A person

who violates this prohibition intending to mislead others into believing he or she is

a peace officer is guilty of a misdemeanor and is subject to a fine of up to $10,000 or

imprisonment for no more than nine months or both. A person who violates this

provision to commit or aid or abet the commission of a crime is guilty of a felony and

is subject to a fine of up to $10,000 or imprisonment of up to six years or both. In

addition, any vehicle used in the violation of the prohibition is subject to seizure and

forfeiture proceedings. This bill creates parallel provisions for impersonating a fire

fighter, an emergency medical technician, or a first responder.

Because this bill creates a new crime or revises a penalty for an existing crime,

the Joint Review Committee on Criminal Penalties may be requested to prepare a

report concerning the proposed penalty and the costs or savings that are likely to

result if the bill is enacted.
