What this bill does

Under current law, a person who is arrested for a domestic abuse incident may
not go to the residence of the alleged victim of the incident or contact the alleged
victim for 72 hours after he or she is arrested unless the alleged victim signs a waiver
that would allow the person to go to the home or make contact. A person who does
so is subject to a forfeiture of up to $1,000.
Under this bill, a person who violates these provisions is guilty of a Class A
misdemeanor and is subject to a fine not to exceed $10,000, imprisonment not to
exceed nine months, or both.
Because this bill creates a new crime or revises a penalty for an existing crime,
the Joint Review Committee on Criminal Penalties may be requested to prepare a
report concerning the proposed penalty and the costs or savings that are likely to
result if the bill is enacted.
