This bill prohibits customers under the age of 18 from using a tanning facility.

Under current law, no person may operate a place or business that provides persons

access to a tanning device without a permit issued by the Department of Health

Services (DHS). Such a place or business is referred to under current law as a

tanning facility. Current law also contains a number of provisions regulating the use

and operation of tanning devices and facilities, including provisions requiring the

owner of a tanning facility to ensure that: 1) no customer under 16 years of age is

permitted to use the tanning facility; and 2) during operating hours, a trained

operator is present at the tanning facility. DHS may suspend or revoke a permit

issued to operate a tanning facility if the permit holder or his or her employee violates

any of these provisions. In addition, any person who violates these provisions may

be required to forfeit not less than $50 nor more than $250. This bill increases the

minimum age for use of a tanning facility from 16 to 18 years and specifies that the

owner of a tanning facility is required to ensure that no customer under 18 years of

age is permitted to use the tanning facility.
