Under current law, it is a Class I felony for a person to assume to act in an official

capacity of a public office knowing that he or she is not a public officer, employee, or

utility employee or to exercise any function of a public office that he or she is not

qualified to exercise.

Under the bill, it is a Class I felony for a person to impersonate or represent

oneself to be a public officer, employee, or utility employee with the intent to mislead

others into believing that he or she is actually a public officer or employee or the

employee of a utility.

Because this bill creates a new crime or revises a penalty for an existing crime,

the Joint Review Committee on Criminal Penalties may be requested to prepare a

report.
