What this bill does
Plain-language analysis by the nonpartisan Legislative Reference Bureau
Current law prohibits political subdivisions from regulating the amount of rent
or fees charged for residential rental property and from imposing inclusionary
zoning requirements. Inclusionary zoning requirements are requirements that
prescribe “that a certain number or percentage of new or existing residential
dwelling units in a land development be made available for rent or sale to an
individual or family with a family income at or below a certain percentage of the
median income.” This bill eliminates these prohibitions.
Because this bill may increase or decrease, directly or indirectly, the cost of the
development, construction, financing, purchasing, sale, ownership, or availability of
housing in this state, the Department of Administration, as required by law, will
prepare a report to be printed as an appendix to this bill.
