What this bill does

This bill prohibits health insurance policies and plans, including self-insured governmental plans, and the Medical Assistance program from knowingly covering a human organ transplant or posttransplant care if the transplant operation is performed in or the human organ to be transplanted was procured by sale or donation originating in the People’s Republic of China or in another country, as designated by the Department of Health Services, known to have participated in forced organ harvesting. However, the bill does not prohibit any posttransplant service or care provided to save the life of an individual after the individual receives a human organ transplant that is prohibited under the bill. The bill defines “forced organ harvesting” as the removal of one or more organs from a living person, by means of coercion, abduction, deception, fraud, or abuse of power over a position of vulnerability, or from a person killed for the purpose of removal of one or more organs. Under the bill, DHS may designate a country whose government funds, sponsors, or otherwise facilitates forced organ harvesting to be included in the prohibition. The Medical Assistance program is a joint federal and state program that provides health services to individuals who have limited financial resources.
