Under current law, any person who deposits a tire or other large item on or along any highway, in any waters of the state, on the ice of any waters of the state, or on any other public or private property is subject to a forfeiture of up to $1,000.

This bill provides that a person who deposits four or more tires on the private property of another is guilty of a Class A misdemeanor and requires a court that sentences a person who has deposited four or more tires on the private property of another to order restitution in an amount equal to the actual costs to the property owner for properly disposing of any unlawfully deposited tires.

Under current law, the penalty for a Class A misdemeanor is imprisonment for up to nine months or a fine of up to $10,000 or both.

Because this bill creates a new crime or revises a penalty for an existing crime, the Joint Review Committee on Criminal Penalties may be requested to prepare a report.
